Standing Rock: Upholding the Constitution Against DAPL's Violations

Immediate Reflection and Action on Standing Rock Needed!

It is a time to decide whether or not the Declaration of Independence and the United States Constitution, by and for the people, will continue to govern the United States of America! Or will the United States of America be regulated and controlled by the money, greed, and immoral actions and practices of certain multinational corporations and their legally responsible, representatives?

Since last Monday, November 28, Walking the Red Road has been sharing the reality that Energy Transfer Partners was moving forward 24/7 to complete the DAPL. As well, all evidence led to the apparent conclusion that DAPL had already initiated illegal tunneling under Lake Oahe.

We publically stated, days before the historic legal decision by the President of the United States via the Department of the Army to stop DAPL from entering Standing Rock Sioux/Federal Land, the following:

"According to visual observations, including a large drill bit being delivered more than a week ago, it is clear that DAPL is violating the US Army Corps of Engineer’s position stated on November 14th and had initiated tunneling under Lake Oahe. This must mean that DAPL is willing to pay $29 Million in fines to complete the pipeline by January 1, 2017, or DAPL may assert discussions are not “ongoing” and, therefore, have the legal right to continue moving forward 24/7 to complete their pipeline on time.

DAPL is not twiddling their thumbs, sitting respectfully, and doing what the Federal Government ordered. DAPL is currently moving forward with the pipeline through Army Corps/Standing Rock Sioux Tribal land.

Kelcy Warren, CEO of Energy Transfer Partners (the company building DAPL), has made it clear on numerous occasions that they are not going to stop building DAPL. He has stated during numerous interviews that, ‘The protests will have no effect. We are building the pipeline!” Mr. Warren is moving forward, true to his word, with the formal support of President-elect Donald Trump.

We concluded our statement regarding the apparently illegal actions of Energy Transfer Partners, the Governor and State of Dakota and DAPL, as follows:

“Now, I am not so wise as those lawyer guys, but just between us two,” poetically stated by Robert Service, in the “Shooting of Dangerous Dan McGrew,” these questions seem worthy of an honest answer. As well as, immediate and direct investigation to the point of full, free and prior disclosure.”

Given yesterday’s public statement by the Department of the Army and the public response by Energy Transfer Partners and Sunoco Logistics Partners, these are some Constitutional positions and resulting actions that need to considered, from my perspective, by all concerned. We need to transcend personalities and political affiliations to come to definite conclusions and immediate action to protect any and all violations of the United States Constitution and related legislation:

1) Every member of the US Military current or veterans, and every individual holding a public office, including, the Governor of the State of North Dakota, has verbalized and signed this Sacred Oath.

"I, _____, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed.”

2) Every American citizen, including the President-elect of the United States, has the duty and responsibility to support, adhere to, and uphold the spirit and intent of the Constitution of the United States of America.

3) Every active or reserve duty member of the United States Military is sworn to obey the orders of the United States Commander in Chief, the President of the United States.

4) The United States Commander in Chief, via the Department of the Army, has denied Energy Transfer Partners and Sunoco Logistics Partners the easement for the Dakota Access Pipeline to cross the Missouri River at Lake Oahe.

5) Any past or future action that have been or are undertaken by Energy Transfer Partners and Sunoco Logistics Partners that violates this (or past) orders by the President of the United States, or his officers, is in direct violation of the Constitution of the United States of America.

6) On March 20, 1965, President Lyndon B. Johnson sent Federal troops to uphold the United States Constitution when it was violated by the State of Alabama and its Governor for Civil Rights violations against its citizens.

7) The numerous violations of the United States Constitution, related legislation and internationally recognized Human Rights, by Energy Transfer Partners, Sunoco Logistics Partners and the State of North Dakota, in every manner and dimension, deserve the same Federal Military Action enacted by Commander and Chief, Lyndon B. Johnson on March 20, 1965.

8) Given the urgency, immediate action is needed to halt these violations of the United States Constitution and potential violence against U.S. Citizens that are standing up and protecting our inalienable rights and treaties that constitute the Supreme Law of the Land.

9) It is a time to decide whether or not the Declaration of Independence and the United States Constitution, by and for the people, will continue to govern the United States of America! Or will the United States of America be regulated and controlled by the money, greed, and immoral actions and practices of certain multinational corporations and their legally responsible, representatives?
